1. Introduction
Chotpot India Technologies Pvt. Ltd. is a quick e-commerce and food delivery platform operating from Berhampore, Murshidabad. We strive to provide seamless ordering, high-quality service and local delivery support in rural and semi-urban areas. These Terms form a legal agreement between you (the “customer”) and Chotpot India Technologies Pvt. Ltd.

Core services: online food delivery, quick-commerce delivery of daily essentials, local vendor partnership services and express delivery within designated service areas

We act as a facilitator between customers and vendors. Quality, availability and preparation of goods, especially food, are the responsibility of the respective vendor.

5. Orders and Payments
5.1 Placing Orders
Orders can be placed only through our official mobile app or website.
Once placed, orders cannot be modified.
5.2 Order Cancellation
You may cancel an order only while it is in the “Pending” stage.
Once an order is Confirmed, it cannot be cancelled, changed or refunded under any circumstances.
The app automatically disables cancellation once the vendor confirms the order and it is allocated for delivery.
5.3 Payments
Payment must be completed when placing the order.
Available methods may include UPI, cards, wallets, net banking and COD (where applicable).
If a payment fails, the order will not be processed.
5.4 Pricing
All prices shown at checkout are final.
Prices may change at any time due to vendor updates or platform adjustments.
Applicable taxes and delivery charges are shown before final confirmation.
6. Delivery
6.1 Delivery Time
We make every effort to deliver within the estimated time shown in the app. Actual time may vary due to weather, high order volume, traffic or road conditions, vendor preparation delays, or technical and logistical challenges. ChotPot is not responsible for delays caused by external factors.
6.2 Delivery Charges
Delivery charges, if applicable, are clearly shown at checkout and may vary with distance, time, surge demand or promotional offers.
6.3 Failed Delivery
An order may be marked “Delivered” without handover if the customer is unreachable, the delivery location is incorrect or inaccessible, or the customer does not respond to calls during delivery. No refund is issued in such cases.
7. Returns and Refunds
7.1 Food Orders
Food items are not eligible for return because they are perishable.
For wrong items, spoiled food or damaged orders, contact customer support within 24 hours of delivery.
Refunds or compensation are provided at the company's discretion after investigation.
7.2 Non-Food Products
Returns of non-food items may be accepted for defective or damaged products, incorrect items or missing items, evaluated case by case. See also our Refund Policy.
8. User Responsibilities

Do not misuse coupons, offers or referral systems
Do not hack, interfere with or disrupt the app
Do not engage in fraudulent activity or false complaints
Violations may result in account suspension or legal action.
9. Privacy Policy
Our Privacy Policy explains what data we collect, how we store, protect and use it, and your rights. By using our Services, you consent to those practices.
10. Limitation of Liability
To the fullest extent permitted by law, Chotpot India Technologies Pvt. Ltd. is not liable for indirect, incidental or consequential damages; delivery delays; vendor-related issues such as taste, quality or hygiene; technical failures or app downtime; or misconduct by third-party vendors or delivery partners. Our total liability in any case will not exceed the value of the order placed.
11. Changes to Terms
We may revise or update these Terms at any time. Changes take effect immediately on posting in our app or website, and continued use means you accept the updated Terms.
12. Governing Law
These Terms are governed by the laws of India. Any disputes fall under the exclusive jurisdiction of the courts in Berhampore, Murshidabad, West Bengal.

At ChotPot we are committed to clean, hygienic and high-quality dining experiences. Every restaurant on our platform is monitored regularly and we review their materials for safety and quality.
Please note: ChotPot is a delivery platform. We do not cook or prepare food. Restaurants are responsible for food quality, taste and quantity. Our role is timely delivery and reliable support.
1. Refund Eligibility
A. Food Taste-Related Issues
The restaurant is fully responsible for taste and cooking quality. ChotPot verifies every complaint thoroughly. If the restaurant accepts the complaint, a refund is issued. If the restaurant rejects it after verification, no refund is provided.
B. Cancellation of Prepaid Orders
Both prepaid and COD orders may be cancelled while the order is in Pending status. If cancelled while Pending, a full refund is issued to the original payment method within three to five business days. If the status shows Handover, no refund is allowed because the order has already been prepared and handed to the delivery partner. For urgent help, contact Live Chat or Customer Support immediately.
C. Packaging or Container Damage
ChotPot takes responsibility when the food container or packet is cracked or damaged, or the food spoils during delivery. Report the issue to customer support or live chat within 30 minutes of delivery; later complaints are not accepted.
D. Non-Delivery Due to Customer-Side Issues
For prepaid orders, no refund is provided if the delivery partner arrives on time but cannot deliver because of customer-side issues such as not answering calls, a wrong or incomplete address, being unavailable, or ordering from outside the serviceable zone.
E. Missing Items or Wrong Quantity
Restaurants are responsible for quantity accuracy and missing items. A refund is provided only if the restaurant accepts the complaint. To complain, contact support right after delivery, provide photos as proof and submit within 30 minutes. Later complaints are not accepted.
F. Non-Delivery Due to Platform Issues
If an order is significantly delayed because of a platform issue and the customer refuses it, prepaid orders receive a full refund. No refund is issued if the delay is caused by external factors such as traffic, accidents, railway gate closures, road blockages or other unavoidable situations. If an alternative delivery arrangement is made and the order still arrives, refusing it does not qualify for a refund.

3. Refund Processing
Prepaid orders: refunds are processed within 5–7 working days to the original payment method.
COD orders: refunds are issued to the ChotPot Wallet or by bank transfer after collecting customer details.

Mistakes are forgivable, but at ChotPot we work hard to make them rare.

1. Cancellation Timeframe
Before Restaurant Confirmation
If you cancel before the restaurant has confirmed or begun preparing the order, a full refund is generally issued.
After Preparation Begins
If the restaurant has already started preparing the food, a cancellation fee may apply or, in some cases, no refund may be issued depending on the stage of preparation.
2. Cancellation Fees & Conditions
A small cancellation fee may apply when an order is already being processed by the restaurant or delivery partner. These fees compensate:
The restaurant for food already prepared or ingredients used
The delivery partner for time spent or travel already started
The fee may vary by order type, location and restaurant policy.
3. How to Cancel an Order
In-App Cancellation
You can cancel only if the restaurant has not confirmed the order, directly from the Order Details section.
Pending / unconfirmed orders: cancellation option available
Confirmed orders: cancellation option disabled
For a special or urgent reason, you can always reach out through Live Chat or Customer Support, who will help based on eligibility and restaurant policy.
Customer Support Assistance
If in-app cancellation is unavailable, contact support. Refunds cannot be guaranteed once preparation has begun.
4. Refund Process for Cancelled Orders
Full refund: when the order is cancelled before the restaurant confirms it
Partial refund: possible if cancelled while in progress, depending on preparation status and restaurant rules
Timeframe: typically processed within a few business days, varying by payment method (UPI, wallet, card, etc.)
5. When Cancellation Is Not Allowed
Custom-made, bulk or high-value orders
Orders from restaurants with a strict no-cancellation policy
Orders that are already prepared or near delivery

ChotPot is dedicated to timely, efficient delivery of every order. Delivery timelines may occasionally vary due to operational conditions, but we aim to keep the process dependable and transparent at every step.
2. Estimated Delivery Timeframe
Order confirmation to delivery: 40–60 minutes (preparation plus transit)
Food preparation: 10–20 minutes, depending on the restaurant's workload, the complexity and quantity of items, and ingredient availability
Delivery transit: 20–40 minutes, depending on distance, traffic, weather and road accessibility
3. Factors Affecting Delivery Timelines
Delays may occur due to factors beyond our direct control, including heavy traffic or roadblocks, adverse weather, high order volume or peak hours, and technical or operational constraints. ChotPot is not liable for unavoidable delays caused by such circumstances, though we work to minimise inconvenience.
4. Real-Time Tracking & Notifications
The ChotPot app provides updates at each stage: order received, food preparation started, out for delivery, and delivery completed. You also receive push notifications about any delay or change in status.
5. Delay Management & Support
If there is an unforeseen delay, we will notify you promptly through the app or SMS, provide an accurate revised delivery time and ensure the food still reaches you in the best possible condition. Our support team is available during service hours.
6. Delivery Coverage Area
ChotPot operates within designated serviceable zones. Availability depends on your exact location, verified automatically when you place an order. Some remote or restricted areas may be outside our network.
7. Customer Responsibilities
Provide an accurate delivery address
Keep your phone reachable for delivery coordination
Be present at the delivery location during the estimated time
Failure to respond or accept the order may result in cancellation or delay.

All partner restaurants follow strict food handling and hygiene protocols, and delivery partners follow recommended safety guidelines for secure, careful handling in transit.
